Snow Alert Ordinance of Huntington County, Indiana

This ordinance shall be known as the "Snow Alert Ordinance of Huntington County, Indiana" and shall apply to all roads maintained by the Huntington County Highway Department.
The Board of Commissioners, after consultation with the Huntington County Highway Department and/or the Huntington County Sheriff, may declare a snow alert by executive order, when, in its judgment, such would be in the best interest of the public safety and welfare of the residents of Huntington County. Such emergency shall continue in effect until the Board or any member thereof or the Board’s designate herein, determines that an emergency no longer exists and terminates the emergency order.
A. Level One (1) Snow Alert
Motorists shall travel at their own risk and they are in violation of this ordinance if they are on any county road, highway, or right-of-way thereof, blocking or impeding the travel of any vehicle, including any blocking or impediment caused by their stuck, stalled or abandoned vehicle.
B. Level Two (2) Snow Emergency
All motor vehicle travel is prohibited.
Publication and broadcast of the proclamation of a Snow Alert shall be done by the Board or its designated person using a press release to the area news media.
Those vehicles exempt from this ordinance shall include medical assistance, police, fire, civil defense and public utility vehicles and employees of any of the above when they are traveling directly to and from work at one of the above exempt services. Any vehicles violating this Ordinance are subject to removal by towing or other means at the expense of the owner of the vehicles when such towing and/or removal is deemed necessary by the County Highway Department or the County Sheriff’s Department.
Any person violating any provision of this Ordinance shall be guilty of the commission of an infraction and may be fined any sum not to exceed One Hundred Dollars ($100.00) and such shall be enforceable in any Court of law duly authorized by Indiana State law, and in addition to such fine the Court shall be authorized to direct the violator to repay the County of Huntington any monetary losses or expenses incurred in the incident.
